Blue Dahu SA is the seller of all products and services on the site lovguru.ch

The website www.lovguru.ch (hereinafter "the Site") is an e-commerce site accessible through the Internet, open to any user of this network.

It is operated by the company Blue Dahu SA, a company (hereinafter referred to as BDSA), whose registered office is Chemin de Geffry, 7 CH-1073 Savigny, registered in the Trade and Companies Register of the Canton of Vaud under the number CHE 140,375,642.

The Site allows BDSA to offer its products (hereinafter "the Products") for sale in Switzerland and abroad. The Site is reserved for individuals and is prohibited to professionals (or any other commercial purpose). These General Conditions of Sale (hereinafter "Terms") govern the use of the Site and services (hereinafter "the Services") that may be offered, as well as any purchase that would be made on the Site. Any use of the Site implies the full and complete adhesion of the Customer to these Terms and Conditions. The acceptance of the GTC is done by ticking the box "I read the terms and conditions of sale and I adhere to it without reservation" when creating a customer account.

Full and entire acceptance is necessary and any acceptance subject to a reservation is considered null and void. In case of modification of these Terms, the applicable GTC are those in force on the date of use of the Services or the order. Art.n ° 1: Products

The essential characteristics of the Products are presented on the Site in each of the Product sheets. The customer is fully informed that the images, photos and colors of the items offered for sale may not correspond to the actual colors due to the effect of the Internet browser or the screen used.

Products for sale on the Site are available within the limits of available stocks. If one or more items ordered are no longer available, the Customer will be informed by e-mail as soon as possible. The Customer may then cancel the order of the article or articles concerned and be reimbursed the sum already paid if necessary, by crediting the bank account corresponding to the credit card used to pay at the latest in the 30 days.

Art.n ° 2: The Price

The prices of the Products sold on the Site are indicated by the article referenced and are in Swiss francs.

The prices of the products are those indicated on the Site regardless of the place of delivery and include all Swiss taxes (TTC), excluding shipping costs, which are the responsibility of the Customer. It is specified that the customs duties and any taxes requested upon delivery in certain countries in which the Products are likely to be delivered, are not included in the prices and are the responsibility of the customer. Any change of the legal rate applicable to VAT will automatically be reflected in the prices of items as soon as it enters into force on our site. When ordering, the Customer is asked to create an account allowing him to see his pre-entered data, to benefit from dedicated promotional offers. The Customer must fill out a Personal Information Form with the utmost honesty and is obliged to update and keep the required information current at all times. The Customer must also choose an e-mail address and a password that will be requested each time he wishes to access his account. The personal information of the Customer is thus protected by a username (email address) and password so that the Customer, and he alone, has access. BDSA insists that the Client never discloses this information to anyone. The Client must also disconnect from his profile and close his browser window after each session. This protects the Customer and reduces the risk that other users of the medium he used for connection will gain access his personal information. The Customer is solely responsible for the confidentiality of his password. The Customer alone will bear the consequences of any fraudulent use of his password. By placing an order, you certify to BDSA that you are 18 years of age or older.

Art.n ° 4: Steps for the Processing of the Sale

  • The Customer enter the BDSA website domain www.lovguru.ch
  • The Customer adds the items into his basket.
  • The Customer completes the account creation form.
  • The Customer checks the elements of his order, identifies and corrects any errors made during the entry by issuing an order summary.
  • The Customer validates the order, the total price and the all-inclusive price, by clicking on "Proceed with Purchase", which implies the acceptance of BDSA's Terms and Conditions of Sale.
  • The Customer receives an electronic acknowledgment of receipt containing the elements of his order. The order will then be confirmed only after acceptance of the payment by the Credit Card Issuer or the Bank of the Customer and BDSA has receipt of the order amount.
  • The Customer receives an electronic confirmation of his order.
  • The Customer receives his parcel at the delivery address he indicated when ordering.

The summary of the order will also be available on the Site in the "My Account" section, category "my orders". All orders will be validated only after acceptance of the payment. At the end of the payment procedure, a confirmation of the order is transmitted by BDSA to the Customer by email to the email address indicated by the Customer. The Customer accepts that the invoice is considered as proof of the contractual relationship between the parties. The Customer will have the opportunity to print the invoice sent with the order confirmation.

Art. n° 5: Retention of title

The Products remain the property of BDSA until the receipt of payment for the order.

Art. n ° 6: Payment terms

The full payment must be made when ordering. BDSA does not accept partial payment or Deposits under any circumstances. The Customer can settle his order with one of the payment methods below. Any order placed on the Site implies the guarantee on the part of the Customer that he has all the necessary authorizations to use the means of payment made available on the Site. BDSA reserves the right to suspend or cancel any order if it encounters difficulties in the collection of payment.

swissbilling SA is a service provider, that allows you to receive your order with an invoice in a simple and secure way.
The Invoice will be sent from swissbilling separately from your order, per email or regular mail, depending on your choice. swissbilling’s services are based on a fix fee and your maximum order for the first purchase is CHF 350.00. The invoice is payable within 30 days. For security matters, shipping address and billing address must be identical. swissbilling keeps the right to have a credit check control done through it’s partner CRIF AG in Zurich (Tel.: 044 913 50 50, www.crif.ch).

PostFinance (PostFinance Card or E-Finance) - Switzerland only

With PostFinance, you can pay comfortably, securely and free of charge on the Internet. The amount is charged directly to your post account on the day of the order. For more discretion, the transaction will be named "Blue Dahu SA" on your statement.

Credit card

A simple and totally secure solution is to pay for your purchases with a credit card. We accept MasterCard and VISA. The transmission of the data and the validation of the payment are carried out via the Postfinance collection agency. Art.n ° 7: Anti Fraud

BDSA reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over the payment of a previous order. Any resale of products purchased on the Site is strictly prohibited. As such, each order is limited to a total of 20 items maximum. In addition to fighting against fraud, BDSA has set up a system implementing exclusion lists, which can lead:

 

  • To request, in order to secure the transaction, certain supporting documents once the payment has been made, in the event of an automatic alert triggered by the information relating to the order.
  • To block any order from a Customer account that was previously fraudulent.

Art. n ° 8: Delivery

For any order placed on the Site, we commit ourselves to prepare your order within a maximum of 48h (excluding weekends and holidays) for Switzerland and within a maximum of 10 working days in period of strong activities (Christmas, sales, etc.). It is the Customer's responsibility to choose the method of delivery during the ordering process. BDSA offers the delivery costs for any order over 85CHF. The Client can request that the items ordered are delivered to his home, his office, to a third party, or to his vacation address, etc. He also has the faculty to have the items delivered to one of the natural persons of his choice. In case of error in the wording of the Customer's details, BDSA cannot be held responsible for the incorrect delivery of the item(s) ordered(s). When a package leaves the warehouses of the company BDSA it is sent to the address indicated by the Customer when ordering, the latter receives electronically from the Site a shipping confirmation. The Customer can follow the progress of the processing and delivery status of his order in his personal "My Account" secure area accessible on the Site. Are considered in particular as force majeure releasing BDSA from its obligation to deliver: war, riot, fire, flood, strikes, accidents, and any other impossible circumstance which prevents delivery.

In any case, the delivery of our products within all of our deadlines can happen only if the Customer information supplied to us is correct and thus both parties are fulfilling their obligations correctly. It is up to the Customer to verify the delivery on its arrival, making sure that all is in good order before accepting and signing for the package. Any reservations and claims which would appear justified such as if  the package is likely to have been opened or if it shows obvious signs of deterioration. one should refuse acceptance of the delivery. Any reservations and complaints must be sent to the Post Office by registered letter with the acknowledgment of receipt.

Art. n° 9: Returns

It is reminded that the statutory withdrawal period in accordance with the Consumer Code is 7 clear days, without having to justify reasons or to pay penalties. This period runs from receipt of the Products or acceptance of the offer for the Services. The withdrawal period does not begin to run again in the event of an exchange according to the conditions set out in article 8. Once the Products have been received, checked, and accepted by our services, the refund of the Products returned to the invoice price as well as the shipping costs related to the return package, will be made by a credit of the amount to be refunded to the Customer's bank account. debited during the transaction. Art. No. 13: Applicable Law and Jurisdiction

In case of translation of the Site and BDSA, the French language prevails for interpretation. These Terms are subject to Swiss law. Any dispute that may arise concerning their validity, their interpretation, and their execution subject to the exclusive jurisdiction of the Courts of Lausanne unless otherwise mandatory rule of procedure.
